These Terms of Service ("Terms") govern access to and use of WiserTask, provided by Dyak Inc. ("Dyak," "WiserTask," "we," "us," or "our"). By creating an account or using WiserTask, you agree to these Terms.
1. ELIGIBILITY
You must be at least 13 years old to create or use a WiserTask account. You represent that you meet the applicable minimum age requirement and have legal capacity to agree to these Terms.
2. SERVICES
WiserTask is a productivity and task-management service that may provide task organization, schedules, calendars, reminders, email, SMS, WhatsApp and push notifications, sharing/collaboration features, subscriptions, and related productivity tools. Features may change over time.
3. ACCOUNTS
You are responsible for accurate account information, safeguarding credentials, activity under your account, keeping contact information current, and notifying us of suspected unauthorized access. You may not impersonate another person or use an account for fraud or unlawful activity.
4. ACCEPTABLE USE
You may not use WiserTask to violate law; commit fraud; harass, threaten, or harm others; distribute malware; attempt unauthorized access; interfere with the Services; abuse communications functionality; send unlawful or unsolicited communications; circumvent security or usage restrictions; scrape or reverse engineer except where law expressly permits; or otherwise misuse WiserTask.
5. SUBSCRIPTIONS, BILLING, AND AUTO-RENEWAL
WiserTask may offer free and paid functionality, including auto-renewable subscriptions. Before a subscription is initiated, the purchase interface must disclose the subscription name, what is included, duration/renewal period, price, and applicable auto-renewal information.
For purchases through Apple's App Store, Apple processes payment and manages the subscription under Apple's terms. For purchases through Google Play, Google processes payment and manages the subscription under Google's terms.
Unless canceled in accordance with the applicable platform's procedures, an auto-renewable subscription renews for the disclosed renewal period at the applicable price. Users are responsible for managing cancellation through the platform through which they subscribed. Deleting the WiserTask app or WiserTask account does not itself cancel an app-store subscription.
6. APPLE APP STORE USERS
If you obtain WiserTask through Apple's App Store, use of the licensed iOS application is also subject to Apple's applicable terms. Unless a custom EULA is expressly provided for WiserTask in App Store Connect, Apple's Standard End User License Agreement applies:

Apple is not responsible for WiserTask support except as required by applicable law or Apple's own terms.
7. GOOGLE PLAY USERS
If you obtain WiserTask through Google Play, your download, purchase, subscription, and use may also be subject to Google Play's applicable terms and policies.
8. SMS MESSAGING
SMS participation is optional and is not a condition of purchase. Users who affirmatively opt in may receive messages within the scope of the consent provided, such as verification codes, task reminders, and account/service notifications. Marketing or promotional SMS requires separate consent when required by law or messaging policy.
Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe from applicable recurring SMS messages and HELP for help.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service and messaging delivery, is permitted. All other use-case categories exclude text messaging originator opt-in data and consent; this information will not be shared with third parties.

9. EMAIL, WHATSAPP, AND PUSH COMMUNICATIONS
Depending on settings and permissions, WiserTask may communicate through email, SMS, WhatsApp, push notifications, or within the Services. Transactional/service communications may be necessary to operate requested features. Promotional communications are subject to applicable consent and opt-out requirements. Promotional push notifications require explicit opt-in and an in-app opt-out method.
10. USER CONTENT
You retain ownership of content you submit, such as tasks, reminders, notes, and goals. You grant WiserTask a limited, non-exclusive license to host, process, reproduce, transmit, and display that content only as reasonably necessary to operate, secure, maintain, and improve the Services and as otherwise authorized by you.
11. AI FEATURES
Some current or future WiserTask features may use artificial intelligence. AI-generated output may be inaccurate, incomplete, or inappropriate and should be reviewed by the user. WiserTask is not a substitute for professional medical, legal, financial, safety, or emergency advice. If personal information or user content is to be sent to a third-party AI provider, WiserTask will provide disclosure and obtain explicit permission where required before such transmission.
12. INTELLECTUAL PROPERTY
WiserTask software, branding, logos, interfaces, designs, and proprietary materials are owned by Dyak Inc. or its licensors and protected by applicable intellectual-property laws. No ownership rights are transferred to users except the limited right to use the Services under these Terms.
13. THIRD-PARTY SERVICES
WiserTask may rely on third-party platforms and service providers. Their services may be subject to their own terms and policies. We are not responsible for third-party outages, changes, or conduct outside our reasonable control.
14. SERVICE AVAILABILITY AND REMINDER DELIVERY
We work to provide reliable service but do not guarantee uninterrupted or error-free operation or that any reminder, email, SMS, WhatsApp message, or push notification will be delivered or delivered at a particular time. Do not rely on WiserTask for emergency, life-safety, medical, legal-deadline, financial-trading, or other mission-critical communications.
15. DISCLAIMERS
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISERTASK IS PROVIDED "AS IS" AND "AS AVAILABLE." DYAK INC. DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
16. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DYAK INC. AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO WISERTASK. Nothing in these Terms limits liability that cannot legally be limited.
17. SUSPENSION AND TERMINATION
You may stop using WiserTask at any time. We may suspend or terminate access when reasonably necessary for violations of these Terms, unlawful activity, fraud, abuse, security risks, or protection of users, WiserTask, or others.
18. ACCOUNT DELETION
Users may initiate account deletion in the app and through /delete-account. Account deletion does not automatically cancel a subscription administered by Apple, Google, or another payment platform.

20. CHANGES
We may update these Terms. Material changes may be communicated through the Services, website, email, or another appropriate method. Continued use after updated Terms become effective constitutes acceptance to the extent permitted by law.
21. GOVERNING LAW
These Terms are governed by the laws of the State of California and applicable United States law, without regard to conflict-of-law principles, except to the extent applicable consumer law requires otherwise. Mandatory consumer rights in a user's jurisdiction are not waived.
